(a)
After evaluating applications according to the criteria in § 410.21 and consulting, to the extent practicable, with boards of trustees and the tribal governments chartering the institutions being considered, the Secretary determines whether the most highly rated applications are equitably distributed among Indian tribes.
(b)
The Secretary may select other applications for funding if doing so would improve the distribution of projects among Indian tribes.
(c)
In addition to the criteria in § 410.21, the Secretary considers whether funding a particular applicant duplicates an effort already being made.
