1101.9—Exemptions.
The following are exempt from disclosure under 5 U.S.C. 552a (j) and (k):
(a)
Any record originated by another agency which has determined that the record is exempt. If a request encompasses such a record, the Section will advise the requester of its existence, and of the name and address of the source agency.
(b)
Records specifically authorized under criteria established by an executive order to be kept secret in the interest of national defense or foreign policy, and which are, in fact, properly classified pursuant to such executive order.
(c)
Those systems of records listed as exempt in the Notice of Records of the Federal Register, including: Certificates of Medical Examination; Occupational Health and Injury Files; and Investigative Records.
